Nevada Wrongful Termination Law
Many individuals are employed "at will", in Nevada which means they don't have a formal employment contract with their employer and Nevada state law allows their employment to be ended at any time, or the person does possess a written employment contract which contains an "at will" clause with the same effect. However, even "at will" employees are entitled to certain legal protections against wrongful termination, and cannot be fired for reasons that violate the law or public policy.
Some states will permit an "at will" employee to bring a lawsuit on the basis that the employer violated an implied covenant of "good faith and fair dealing" in association with the termination decision. In such states, even with an at-will employee, the employer must give some fairness in the decision to terminate employment.
The term "wrongful termination" or "wrongful discharge" covers employee actions alleging that the employer wrongfully fired the employee. Wrongful termination can be based on several theories, including breach of an employment contract ,violation of public policy ,constructive discharge, as well as the protective Whistleblower Protection Act Law of 1989 and comparable state laws regarding employees who report company wrongdoing.
However, simply because a person was terminated and it was considered "wrongful" it does not mean that the termination was "unlawful." Although all employees are at-will in the state of Nevada, if there is proof of the existence of an express or implied contract then the employee can only be terminated for "just" or "good" cause.
